A Guide to the New Condominium Act Forms
As of yesterday, many changes
to the Condominium Act came into effect that affect the day-to-day
responsibilities of condo corporations.
Some of the changes require
corporations to use Ministry forms where they weren’t previously required.
The Ministry released the new
forms corporations will have to use for: proxies, to provide notice of meeting,
and the three types of information certificates, among others. Here is a list
of the new forms:
Information
Certificates
This “mini status certificate”
provides owners with updates on finances, insurance, reserve fund, board, and
other matters throughout the year.
Tip: This must be sent out twice per year – within 60 days after the last day of the first and third fiscal quarter.

This certificate is triggered
on certain events, such as a change in the directors, or change of the
corporation’s address for service.
Tip: There are different time periods for sending out the Information Certificate Update depending on the type of triggering event. For example, if the board loses quorum, this must be sent out within 5 days of losing quorum, whereas a corporation has 30 days to send out the notice for a mere change in the number of directors.

This notice contains the most
recent Periodic Information Certificate and Information Certificate Update.
A corporation must send this
notice to owners if it decides to post any of the information certificates
online (such as through property management’s web portal)
Proxies
1. Proxy Form
This form must be used by
owners or mortgagees voting by proxy at a meeting of owners.
Tip: Proxy forms can be used at an adjournment of a meeting of owners. If, for example, there weren’t sufficient owners present at an AGM to pass a by-law, proxies submitted for the purpose of passing a by-law at that AGM can be used at a subsequent meeting of owners.

This is an agreement between
the requester and the corporation that allows the requester to waive certain
rights with respect to the corporation’s response to the record request.
Other Forms
for Owners
This must be used by owners who
wish to call a meeting to fill vacancies on the board if the board loses quorum
and the remaining directors do not call within 15 days of losing quorum, or if
there are no directors in office.
This form must be used by owners if they wish to submit material to the
board to be included in the upcoming Notice of Meeting of OwnersTip: Although owners can request material to be included in the notice of meeting, the board is not obligated to include this material unless the submission is made on behalf of owners of 15% of the units (or more), and the submission would not add anything that is contrary to the Condominium Act or the regulations.

Section 116 Sale by Non Resident
Anyone can purchase real estate in [Toronto] Canada and we do welcome foreign investment. When you sell however there is a with holding tax of 25 % of the sale price of the asset [condo] that you sell.

until the Certificate is obtained.

Developers PASS along charges from City
You hurried. You trusted the Builders agent. You signed a Standard Agreement ... Right?
Often in those agreements are legal speak that says you are responsible for all the development charges. YOUR LAWYER contacts the builders lawyer an CAPPS the closing fees and all development charges in a clause that says they may not exceed XXX dollars.

At what point during your real estate purchase you should consult a lawyer to clearly understand what you are committing to?
The Lawyer handling your real estate purchase carries out the instructions that are agreed upon in the contract. The time to make changes and corrections is before the document is Firm and Binding.
Your contract should include a condition for Financing for a specific period of time, if you are obtaining Financing. It should also include a Clause for a Home inspection by a Qualified and Licensed Home Inspector. Additional Visits into the subject property for trades, people to quote for repairs, renovation and measurements require an additional clause. Be sure to include that the SELLERS will give permission for trades to take pictures and measurements. Visits are meant to show your family what you purchased or re-measure for draperies.
This is a good time to include the Home Owners Insurance Broker and a Search of the Insurance Claim history. Have there been any previous flood or fire damage claims? Does the house have old wiring or an oil tank? Call for details.
It's most important today, to make sure that all your closing costs are capped from the builder/ developer to be a specific amount should municipalities change their lot Levy's; while you are dealing with the Period of Rescission. (cooling off period)
Once an Offer to Finance has been received; Commitment Letter, it will often detail the LENDERS requirements. Review this carefully with your lawyer and Mortgage Broker that you can accommodate all the required terms.
The contract should clearly state IF there is additional HST applicable above the purchase price.
Title Insurance is often a mandatory request that is purchased at the time of closing.
You will also pay Land Transfer Tax on the amount of the Purchase Price.
Searches need to be conducted for any outstanding work orders from the City PLUS any judgements or liens against the property. (that the previous owners may have) The utilities and taxes need to be verified. You may be eligible for Tax Rebates as First Time Home Buyers. Land Transfer Tax calculator.
Your real estate lawyer works in your best interests to secure, probably the most expensive purchase families make. During the time you are at the lawyers office, give some thought to how you hold title (who's name the house be registered) whether it is Joint Tenancy or as Tenants in Common. This is the time to discuss survivorship, your will and testament.
You will receive a Statement of Adjustments (who pays for what) prior to closing, preparing you for the amount of funds to bring to the closing inclusive of fees, taxes and net of your deposit. You will need to bring Photo ID and a credit card for Identification.
